By accessing or using Vibitely (the "Service"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, you may not use the Service.

You must be at least 16 years old to use Vibitely.

2. Description of Service

Vibitely is a comprehensive website building platform that provides tools for creating, editing, deploying, and hosting websites. The Service includes website generation capabilities, visual and code editing tools, image creation features, deployment services, export functionality, community showcase features, and technical assistance tools.

The Service integrates advanced technologies to streamline website creation and management, making professional web development accessible to users of all skill levels.

3. User Accounts

You are responsible for all activity that occurs under your account. You agree not to share your account access with others and to maintain the security of your authentication method (e.g., your Google or GitHub account).

Each user is permitted to maintain only one active account on our platform. This policy helps us ensure fair resource allocation and maintain the quality of service for all our users.

4. User-Generated Content and Ownership

You retain full ownership of all websites, code, images, and content you create using Vibitely. By publishing content to the community showcase, you grant Vibitely a non-exclusive, worldwide, royalty-free license to display it on the Service. You are solely responsible for your content and must ensure it complies with the Content Guidelines and applicable laws.

You may download, export, or delete your projects at any time. Exported content is yours to use without restriction.

5. Platform Features and Automated Tools

The platform includes automated website generation, code optimization, image creation, and technical assistance features. While striving to provide high-quality output, automated tools may occasionally produce results that require adjustment or correction.

6. Hosting and Deployment Services

When you deploy websites using Vibitely's hosting service, you agree to use the service responsibly and in compliance with all applicable laws. Vibitely reserves the right to suspend or terminate hosting for websites that violate the Content Guidelines or these Terms.

While striving to maintain reliable hosting services, 100% uptime is not guaranteed. It is recommended to maintain backups of important projects.

7. Pricing and Future Changes

The Service may include both free and paid features. Vibitely reserves the right to introduce new pricing plans, modify existing plans, or add premium features at any time. Advance notice will be provided for significant pricing changes that affect your current usage.

8. Prohibited Uses

You agree not to use the Service, including any websites hosted on Vibitely subdomains (*.vibitely.com), to create, host, distribute, or facilitate any of the following:

Illegal Content and Activities

• • Content that violates any applicable local, national, or international law or regulation
• • Child sexual abuse material (CSAM) or any content that sexually exploits minors
• • Content promoting or facilitating terrorism, extremism, or violence
• • Drug trafficking, weapons sales, or other illegal commerce
• • Human trafficking or exploitation of any kind

Fraud, Phishing, and Scams

• • Phishing websites designed to steal credentials, financial information, or personal data
• • Websites impersonating banks, payment processors (PayPal, Stripe, etc.), cryptocurrency exchanges, or any financial institutions
• • Fake login pages or credential harvesting sites
• • Fraudulent giveaways, lottery scams, or "prize winner" schemes
• • Investment scams, Ponzi schemes, or fraudulent financial offerings
• • Cryptocurrency scams including pump-and-dump schemes, fake ICOs, rug pulls, or deceptive token offerings
• • Romance scams, advance-fee fraud, or social engineering attacks
• • Fake e-commerce sites designed to steal payment information or never deliver goods

Impersonation and Brand Abuse

• • Websites impersonating other companies, brands, organizations, or individuals
• • Unauthorized use of trademarks, logos, or brand identities
• • Creating websites that could reasonably be confused with legitimate businesses or services
• • Fake customer support or help desk sites impersonating other companies
• • Parody or criticism sites that could be mistaken for official brand properties

Malware and Security Threats

• • Malware, viruses, ransomware, spyware, trojans, or any malicious software
• • Drive-by download attacks or exploit kits
• • Command and control (C2) servers for botnets
• • Cryptojacking scripts that mine cryptocurrency without user consent
• • Browser hijackers, adware injectors, or unwanted software distribution
• • Websites designed to exploit browser or system vulnerabilities

Intellectual Property Violations

• • Content that infringes on copyrights, trademarks, patents, or other intellectual property rights
• • Pirated software, media, or digital content distribution
• • Websites facilitating or linking to copyright infringement
• • Counterfeit goods sales or promotion

Spam and Manipulation

• • Spam websites, link farms, or SEO manipulation schemes
• • Doorway pages designed solely for search engine manipulation
• • Automated content generation for the purpose of gaming search rankings
• • Cloaking or deceptive redirects
• • Affiliate fraud or click fraud schemes

Harassment and Harmful Content

• • Doxxing sites that publish private personal information without consent
• • Harassment, bullying, stalking, or targeted abuse of individuals
• • Revenge porn or non-consensual intimate imagery
• • Hate speech targeting individuals or groups based on race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics
• • Credible threats of violence or incitement to violence
• • Defamatory content designed to damage reputation with false statements

Platform Abuse

• • Attempting to circumvent usage limits, security measures, or access controls
• • Automated scraping, crawling, or data collection beyond normal usage
• • Reselling, redistributing, or sublicensing Vibitely services without authorization
• • Using the platform to attack, probe, or scan other systems or networks
• • Interfering with the Service's operation or other users' access
• • Creating multiple accounts to evade bans or abuse free tier limits

This list is not exhaustive. Vibitely reserves the right to determine, in its sole discretion, what constitutes a violation of these terms and to take appropriate action.

9. Content Moderation and Enforcement

Vibitely reserves the right, but not the obligation, to monitor, review, and moderate all content hosted on or transmitted through the Service. We may take any of the following actions at our sole discretion, with or without notice:

• • Remove, disable, or restrict access to any content that violates these Terms
• • Suspend or terminate any website hosted on Vibitely subdomains
• • Suspend or permanently ban user accounts
• • Preserve content and account information as evidence
• • Report violations to appropriate law enforcement agencies
• • Cooperate with law enforcement investigations and legal processes
• • Disclose user information pursuant to valid legal requests, court orders, or subpoenas

Vibitely proactively monitors for phishing, malware, and other high-risk content. We may use automated systems, third-party services, and manual review to detect violations. Content flagged by security services (such as Google Safe Browsing) may be immediately suspended pending review.

Reporting Abuse: If you encounter content on Vibitely that violates these Terms, please report it to [email protected]. We investigate all reports and take appropriate action.

10. DMCA and Intellectual Property Claims

Vibitely respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA) and equivalent international laws. If you believe content on Vibitely infringes your copyright or other intellectual property rights:

• • Include: (1) identification of the copyrighted work, (2) identification of the infringing material and its location, (3) your contact information, (4) a statement of good faith belief that the use is unauthorized, (5) a statement under penalty of perjury that the information is accurate, and (6) your physical or electronic signature
• • We will promptly investigate and remove or disable access to infringing content
• • We will notify the user who posted the content, who may submit a counter-notice

Repeat Infringer Policy: Vibitely will terminate accounts of users who are repeat infringers of intellectual property rights.

11. Indemnification

You agree to indemnify, defend, and hold harmless Vibitely, its officers, directors, employees, agents, licensors, and service providers from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

• • Your use of the Service or any content you create, upload, or host
• • Your violation of these Terms of Service or any applicable law
• • Your violation of any third party's rights, including intellectual property, privacy, or publicity rights
• • Any claim that your content caused damage to a third party
• • Your fraudulent, negligent, or intentional misconduct

This indemnification obligation will survive the termination of your account and these Terms. Vibitely reserves the right to assume exclusive defense and control of any matter subject to indemnification, and you agree to cooperate with our defense of such claims.

You acknowledge that you are solely responsible for all content you create, host, or distribute using Vibitely. Vibitely acts as a neutral hosting platform and does not endorse, verify, or assume responsibility for user-generated content.

12. Disclaimers and Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

Vibitely does not warrant that: (a) the Service will meet your requirements; (b) the Service will be uninterrupted, timely, secure, or error-free; (c) results obtained from using the Service will be accurate or reliable; or (d) any defects in the Service will be corrected.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL VIBITELY BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, DATA, OR OTHER INTANGIBLE LOSSES, REGARDLESS OF WHETHER VIBITELY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

VIBITELY'S TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO VIBITELY, IF ANY, DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above limitations may not apply to you. In such cases, our liability will be limited to the greatest extent permitted by law.

13. Termination

Vibitely may suspend or terminate your account and access to the Service immediately, without prior notice or liability, for any reason, including but not limited to:

• • Violation of these Terms of Service or Content Guidelines
• • Requests by law enforcement or government agencies
• • Discontinuance or material modification of the Service
• • Unexpected technical or security issues
• • Extended periods of inactivity
• • Engagement in fraudulent or illegal activities

Upon termination: (a) all rights and licenses granted to you will immediately cease; (b) you must cease all use of the Service; (c) any hosted websites may be immediately removed; (d) we may delete your account and all associated data after a reasonable retention period.

You may terminate your account at any time through your profile settings. We recommend exporting any content you wish to retain before deletion.

Survival: Sections relating to intellectual property, indemnification, disclaimers, limitation of liability, and governing law shall survive termination.

14. Governing Law & Disputes

These terms are governed by the laws of the Republic of Lithuania. Any disputes arising from these terms shall be resolved in the courts of Lithuania. As a user, you may also be entitled to the protection of the mandatory consumer protection provisions of your country of residence within the EU.

15. Changes to Terms

These terms may be modified from time to time. Users will be notified of significant changes via email or a notice on the platform. Your continued use of the Service after such changes constitutes your acceptance of the new terms.
